В статье исследуется понятие выявления преступлений в сфере незаконного производства и оборота этилового спирта, алкогольной и спиртосодержащей продукции. Анализируются теоретические подходы к понятию выявления преступлений в разрезе теории оперативно-розыскной деятельности и особенностей оборота алкогольной продукции. Определены отличие от документирования и реализации результатов оперативно-розыскной деятельности, специфика проявления в преступлениях, связанных с незаконным оборотом алкоголя, а также критерии завершенности выявления и ее значение для организации дальнейшей деятельности оперативных подразделений.
Актуальность. Сфера производства и оборота алкогольной продукции характеризуется высокой латентностью и использованием легальных форм предпринимательства для маскировки криминальных схем. В этих условиях традиционные подходы к выявлению преступлений требуют переосмысления, смещая фокус с реактивной фиксации фактов на глубокое аналитическое познание.
Цель. Теоретико-методологическое обоснование выявления преступлений как самостоятельной стадии оперативно-розыскного процесса и раскрытие его специфики применительно к противодействию незаконному обороту этилового спирта и алкогольной продукции.
Результаты. В статье разграничены понятия «выявления-задачи» и «выявления-стадии», определены границы последней и критерии ее завершенности. Автором выделены специфические маркеры преступной деятельности – «хозяйственные аномалии» (технологические, логистические и цифровые несоответствия), выявление которых составляет содержание аналитической работы на начальном этапе оперативно-розыскного процесса. Обоснована концепция «оперативного фильтра», позволяющая оптимизировать ресурсы правоохранительных органов и предотвратить необоснованное вмешательство в законную предпринимательскую деятельность. Сформулирован вывод о том, что эффективность борьбы с алкогольной преступностью напрямую зависит от перехода к инициативной модели оперативного поиска.
The article examines the concept of crime detection in the field of illicit production and trafficking of ethyl alcohol, alcoholic, and alcohol-containing products. Theoretical approaches to the concept of crime detection are analyzed within the framework of the theory of operational-search activity and the specifics of alcohol product circulation. The study determines the distinction between detection and the documentation and implementation of operational-search results, identifies the specifics of manifestation in crimes related to illicit alcohol trafficking, and establishes criteria for the completion of detection and its significance for the organization of further activities of operational units.
Relevance. The sphere of production and circulation of alcohol products is characterized by high latency and the use of legal forms of entrepreneurship to mask criminal schemes. In these conditions, traditional approaches to crime detection require a paradigm shift, moving the focus from reactive recording of facts to deep analytical cognition.
Goal. The goal is the theoretical and methodological substantiation of crime detection as an independent stage of the operational-search process and the disclosure of its specifics regarding the countering of illicit trafficking of ethyl alcohol and alcohol products.
Results. The article differentiates between the concepts of «detection-as-a-task» and «detection-as-a-stage,» defining the boundaries of the latter and the criteria for its completion. The author identifies specific markers of criminal activity – «economic anomalies» (technological, logistical, and digital discrepancies), the detection of which constitutes the content of analytical work at the initial stage of the operational-search process. The concept of an «operational filter» is substantiated, allowing for the optimization of law enforcement resources and the prevention of unjustified interference in legitimate entrepreneurial activity. It is concluded that the effectiveness of the fight against alcohol-related crime directly depends on the transition to a proactive model of operational search.
