Abstract

The article is devoted to the study of the structure of criminal-executive legal relations in the execution of punishment in the form of correctional labor. The relevance of the topic is due to the increasing role of alternative measures to imprisonment in Russian law enforcement practice, as well as the need for a clear delineation of the legal status of subjects and participants in these legal relations in order to increase the effectiveness of their implementation.

The purpose of the study is to determine the specifics of the elements of criminal-executive legal relations, analyze statistical trends in the appointment of correctional labor and form a generalized characteristic of those sentenced to this type of punishment. Based on the analysis of data from the Judicial Department for 2023-2024, it was revealed that the share of correctional labor decreased (8.6% of the total number of convicts), despite the overall increase in alternative punishments (61.5%).

Conclusions: 1) the key subjects of legal relations are penal enforcement inspections and convicts, while organizations, police, prosecutors, and other participants have limited powers; 2) the specifics of legal relations are determined by their imperative nature, normative regulation, and individualized connections between subjects; 3) the termination of legal relations is associated with the expiration of the punishment term or other legal facts. The results emphasize the need to improve the legal regulation of interaction between participants to optimize the execution of correctional labor.
