Ensuring the effectiveness of investigative actions when obtaining information about connections between subscribers and (or) subscriber devices

Abstract

Relevance of the study. In the article, the author examines the effectiveness of conducting an investigative action – obtaining information about connections between subscribers and (or) subscriber devices and considers options for its optimization.

The purpose of the article is to consider some of the issues that arise when receiving information about connections between subscribers and (or) subscriber devices and the need to improve the effectiveness of this investigative action.

Results. The article analyzes the specifics of conducting an investigative action – obtaining information about connections between subscribers and (or) subscriber devices. The author examines the positions of scientists who speak about the effectiveness of investigative actions and the position of scientists who advocate the possibility of rejecting the institution of coordinating a request for information about connections between subscribers and (or) subscriber devices with the head of the investigation and transferring to the head of the body of inquiry the powers of the prosecutor to coordinate petitions before the court, and arguments against such a position. Problematic issues affecting the effectiveness of this investigative action have been identified. The author comes to the conclusion that in order to increase the effectiveness of the designated investigative action and, as a result, the effectiveness of the preliminary investigation in a criminal case, it is advisable to include an investigative action – obtaining information about connections between subscribers and (or) subscribers.
