Police Officers' Abuse of Power in the Use of Force and Weapons: Limits of Criminal Liability

The classification of police officers' actions involving violence remains one of the most controversial in criminal law and law enforcement practice. Establishing the element of committing an act in connection with the exercise of official authority when classifying under Article 286 of the Criminal Code of the Russian Federation is particularly challenging. In practice, situations often arise where police officers use violence outside the scope of their official authority or during a personal conflict, which requires a clear distinction when classifying such actions as official misconduct and general criminal offenses.
The purpose of this paper is to identify criteria for distinguishing between abuse of power and other forms of unlawful violence when police officers use physical force, special equipment, and weapons.
Conclusions. It is concluded that when classifying police officers' actions involving violence, establishing the connection between the act and the exercise of official authority is crucial. In situations of preventing an attack or detaining a person, the circumstances precluding the criminality of the act, as stipulated by Articles 37 and 38 of the Criminal Code of the Russian Federation, must take priority. However, Article 286 of the Criminal Code of the Russian Federation may be applied in cases of a police officer clearly exceeding their authority.
