Abstract

Relevance. Evaluative concepts remain one of the most complex instruments of criminal-law regulation: they make it possible to take into account the diversity of factual situations, but at the same time increase the risk of inconsistent interpretation of criminal law.

Purpose. The article aims to reveal the legal nature of evaluative concepts, to determine their place in the mechanism of qualification of crimes, and to formulate requirements for the reasoning of law-enforcement decisions.

Methods. The research uses formal legal, logical-dogmatic, systemic, comparative legal and interpretative methods, as well as an analysis of doctrinal approaches, legal positions of the higher courts and published materials of law-enforcement practice.

Results. The article substantiates that an evaluative concept is not a manifestation of arbitrary discretion of the law enforcer. Its content is formed at the intersection of legislative, doctrinal, judicial and individual law-enforcement evaluation. It is proposed to regard the standard for applying evaluative concepts as including three elements: identifying the object of evaluation, correlating it with the developed general concept, and providing a reasoned description of the features that allow the relevant criminal-law element to be considered established.
