Selected problems of the hierarchy of criminal execution law sources

The relevance of this research stems from both theoretical and practical needs within legal science to examine how sources of law are ranked hierarchically. When applied to criminal executive law, arranging these sources in order of their authority serves more than an academic purpose: it directly affects legal practice. Contradictions between different sources generate enforcement paradoxes that must be resolved by giving precedence to the legal act possessing greater juridical force.
The purpose. The study aims to analyze how regulatory legal acts governing criminal penalty execution and criminal-legal measures form a coherent system with its own internal hierarchy. An additional goal involves evaluating the extent to which non-traditional sources reshape this system of criminal-executive law sources.
Methods. Formal-legal analysis of criminal-executive legislation and related legal frameworks provides the methodological foundation for this research. A systematic approach complements this analysis, enabling identification of the full range of sources within criminal-executive law.
Results. Based on formal legal analysis, a doctrinal distinction is drawn between the categories "source of penal enforcement law" and "source of penal enforcement legislation", reflecting the relationship between the substantive content of legal provisions and their external statutory expression. Scientific approaches to the subordination of elements within the penitentiary legal system are systematized. The specific status of the Constitution of the Russian Federation is defined as an act of direct effect possessing supreme juridical force that establishes fundamental guidelines for branch regulation without being limited to sectoral instruments. The study substantiates the regulatory significance of ratified international treaties and interpretive decisions of the Constitutional Court of the Russian Federation, which take precedence over ordinary federal legislation and transform penal enforcement relations. Practical conflicts between the codified statute and newly enacted non-codified laws of equal juridical hierarchy are identified, notably the divergence between Article 180 of the Penal Enforcement Code of the Russian Federation and Article 16 of the Federal Law "On Probation in the Russian Federation" concerning the timelines for pre-release re-socialization procedures. Finally, theoretical prerequisites for statutory securing the primacy of the Code are articulated, and an author-developed amendment to Part 1 of Article 2 of the Penal Enforcement Code of the Russian Federation is proposed to eliminate the ambiguity of the phrase "other federal laws".
