Abstract

Relevance of the study. The Criminal Code of the Russian Federation (hereinafter referred to as the Criminal Code of the Russian Federation) prohibits the commission of provocation of a crime in relation to several criminally punishable acts - in relation to bribery, commercial bribery, and bribery in the procurement of goods, works, and services for state or municipal needs. At the same time, other common cases of provocation of crime (situations related to illicit trafficking in narcotic drugs and psychotropic substances, weapons and explosives, etc.) were outside the scope of criminal law regulation. Due to the absence of a single criminal law norm prohibiting the provocation of a crime, the assessment of the provocateur's actions does not differ by a single approach. The widespread occurrence of provocations of crime raises the question of the need to determine the correct legal assessment for both provocateurs and those who commit crimes as a result of provocation.
