Abstract

Relevance of the study. The criminal justice system, designed to maintain public order, uses various forms of punishment to deter and suppress illegal actions. Among them, the restriction of freedom is a subtle approach that seeks to balance punitive measures with prospects for rehabilitation. This study attempts to study and understand the concept and application of restriction of freedom in the field of criminal penalties. By restricting human freedom without resorting to imprisonment, such punishments can offer a cost-effective and humane alternative that can lead to better social reintegration.

The purpose of the article is to formulate and consider restrictions on freedom in the system of criminal penalties. The research aims to better understand and clarify the concept of criminal penalties, as well as to develop recommendations for its effective implementation in various legal fields.

Conclusions. The punishment in the form of restriction of freedom is shown in its comparison with other legal institutions of both Russian and foreign legislation. The development of scientifically based approaches to solving the problems of assigning and executing this type of punishment, and improving its effectiveness, seem important and timely. Restriction of liberty as a form of punishment is a more humane and rehabilitative approach compared to traditional imprisonment, but it is not without difficulties and problems. The key to successful implementation lies in the continuous improvement of the approach to find the optimal balance between punishment, rehabilitation and reintegration into society. Taking into account the characteristics of convicts, solving the problem of unemployment, and ensuring fair application to all age groups make it possible to turn this type of punishment into a more effective and constructive measure of punishment.
