Abstract

. The relevance of the study is due to the contradictions in the normative legal acts governing the legal status of operational units of the penal system. The ambiguity of the norms of the Federal Law
"On Operational Investigative Activities" limiting the powers of the units of the Federal Penitentiary Service of Russia creates legal conflicts and complicates the implementation of tasks to combat crime in penal institutions.

The purpose of the article is to analyze legislative gaps in determining the competencies of operational units of the penal system, as well as to justify the need to harmonize legal norms.

The author's conclusions are as follows: the current version of Art. 13 of the Federal Law
"On Operational Investigative Activities" unreasonably narrows the circle of subjects of operational investigative activities, excluding the majority of institutions. This contradicts the provisions of the penal legislation and other laws enshrining the right of operational units to carry out activities in places of deprivation of liberty. To eliminate the contradictions, it is proposed to amend Art. 13 of the Federal Law "On Operational Investigative Activities", expanding the list of authorized structures. The importance of interdepartmental cooperation, maintaining secrecy and clarifying the regulatory framework for the activities of operational units is emphasized. Keywords: operational investigative activities, institutions and bodies of the penal system, operational investigative measures, operational units, suspects, accused, convicted., Federal Law "On Operational Investigative Activities".
