Legal assessment of the results of operational investigative activities: the concept, areas of use and types

The article analyzes the areas of operational investigative activity. It defines the concept
of “results of operational investigative activity” and outlines the principles and algorithm for their legal assessment. The subject of legal assessment is a legal fact that is of interest to the bodies conducting operational investigative activity. The differences between legal assessment and the classification of acts provided for in the General and Special Parts of the Criminal Code of the Russian Federation are shown.
The relevance of the topic is due to the need to expand theoretical knowledge about the areas
of operational investigative activities provided for by law and supported by practice, as well as the use of their results in solving various social problems.
The aim of the study is to identify the areas in which operational investigative activities are carried out and the possibilities for using their results not only in criminal proceedings but also in other cases provided for by law; to formulate the concept of “legal assessment of operational information” and to define the subject of assessment for all areas of operational investigative activities.
The methodological basis of the study consisted of a formal legal analysis of the provisions of the legislation that establish the directions for carrying out operational investigative activities in relation to various spheres of social life and the use of their results, as well as an examination of judicial practice and literature on the legal assessment of the results of operational‑investigative activities.
Research results. The directions for carrying out operational and investigative activities are shown not only in the field of legal proceedings, but also in the adoption of administrative and managerial decisions; in the field of taxation, registration of legal entities, and in the implementation of foreign investment in economic entities of strategic importance; in ensuring the protection of state secrets; in countering corruption and the commission of offenses in correctional institutions; it is substantiated that the subject of legal assessment is a legal fact, which refers to acts and events that have legal significance; the differences between legal assessment and the classification of crimes are outlined.
